MP revises drug procurement policy giving preference to local industries

The Madhya Pradesh Public Health Services Corporation Ltd (MPPHSCL) has introduced an amendment to its procurement policy giving preference to local suppliers of pharmaceuticals.
MPPHSCL in a notification on July 27, 2021 revised the procurement policy mentioned in the tender floated by the corporation for supply of 173 essential and non-essential drugs to various hospitals run by the state government for 18 months.
The online tender was floated by the corporation on July 7, 2021.
As per the new clause added to the tender, priority will be given to the industries of the state while procuring pharmaceuticals. The newly added clause provides price and purchase preference to MSME drug units in the state.
In MPPHSCL tenders, if the rates are quoted by industrial unit/MSME outside the Madhya Pradesh is minimum/L1 (lowest bidder), then 50 per cent quantity of tender will be purchased from the unit outside the Madhya Pradesh and the remaining will be purchased at the lowest rate from the industrial (MSME) units of Madhya Pradesh, says the revised notification issued by MPPHSCL.
In case the rate of the industrial (MSME) unit of Madhya Pradesh is minimum/L1, then cent per cent purchase will be done through the industrial unit of the state only, it says.
Besides this, the corporation also revised eligibility criteria of suppliers of pharmaceuticals in clause no. 2 in the tender.
As per revised eligibility criteria, the manufacturer should have submitted a valid WHO-GMP certificate issued by licensing authority/ regulatory authority of state/CDSCO of all the manufacturing plants of which pharmaceuticals are being quoted by manufacturer.
The importer should produce valid WHO-GMP/GMP certificate for the plant where said pharmaceuticals are being produced and valid product wise WHO-GMP/GMP/COPP of the all quoted pharmaceuticals or a certificate which is at par with WHO-GMP/GMP issued by exporting countries like US- FDA approval, etc.
Earlier the eligibility criteria mentioned in the tender says the manufacturer should have received a valid cGMP certificate as per revised Schedule M issued by licensing authority and WHO-GMP inspection certificate in line with the WHO certification scheme, on pharmaceuticals being quoted, from the regulatory authority (RA) in India. Bidder should submit a valid (at the time of bid submission date) product wise COPP/product wise WHO-GMP issued by regulatory authority of state/CDSCO, for each item offered.
MPPHSCL further revised technicalities in clause 4 in the tender.
As per the revised technicality, the importer should submit a valid (at the time of bid submission date) product wise certificate of COPP/WHO-GMP issued by regulatory authority, for each item offered. It removed the mandatory requirement for domestic manufacturers to submit product wise COPP/product wise WHO-GMP.
Earlier, the bidder was required to submit a valid (at the time of bid submission date) product wise certificate of COPP/WHO-GMP issued by regulatory authority of state/CDSCO, for each item offered. Welcoming MPPHSCL’s revised procurement policy, Amit Chawla, general secretary, MP Small Scale Drug Manufacturers Association (MPSSDMA) said, “Pharma companies of state will be benefited by purchase preference and rate preference by new amendments in purchase policy.”
The association has been pursuing the issue pertaining to purchase preference for local drug firms in public procurement for a long time. Finally our efforts came to fruition, said Chawla.
Incorporated on March 6, 2014 by the Madhya Pradesh government, MPPHSCL acts as the central procurement agency for all essential drugs and equipment for all public healthcare institutions under the state health and family welfare department. There are around 1300 healthcare institutions under the department.
The company is procuring drugs worth more than Rs. 400 crore and above 250 different types of medical equipment and also provides services needed for the health sector.
On July 7, 2021 MPPHSCL floated an online tender for supply of 173 essential and non-essential drugs to various state run hospitals for one and a half years.
The drugs include actinomycin-D injection, acyclovir tablet/ointment, Adrenaline injection, alfacalcidiol capsule, amoxicillin capsule, artesunate tablet, ampicillin injection, anti snake venom polyvalent injection, azithromycin, carboprost, bleomycin, carbamazepine, betahistine tablet, cefixime tablet, metoprolol, metformin, ofloxacin, paracetamol, ondansetron and hormonal drugs and vitamin supplements etc.
