DGTR to hold final hearing on Nov 10 on anti-dumping duty imposed on Acetone

The Directorate General of Trade Remedies (DGTR) has scheduled final oral hearing on November 10 related to anti-dumping duty imposed on imports of Acetone from European Union (EU), Singapore, South Africa and United States of America (USA). This will conclude the investigation on the case.
The Central government, vide Customs Notification dated March 25, 2019, had imposed definitive anti-dumping duty on the imports of the subject goods originating in or exported from the subject countries.
Acetone is an organic chemical used in the manufacture of bulk pharmaceuticals. Acetone is classified under Chapter 29 of Custom Tariff Act.
A midterm review investigation limited to change of name of producer/exporter from Singapore regarding anti-dumping duty imposed on imports of Acetone from EU, Singapore, South Africa, and the US, was initiated on September 18, 2023 under the Customs Tariff (Identification, Assessment and Collection of Anti-dumping duty on Dumped Articles and for Determination of Injury) Rules, 1995 (AD Rules).
As per Rule 6 (6) of AD Rules “The DGTR may allow an interested party or its representative to present the information relevant to the investigation orally but such oral information shall be taken into consideration by the Designated Authority only when it is subsequently reproduced in writing”.
The hearing will be held in hybrid mode i.e., both through Digital Video Conferencing (DVC) and physically in the conference room of DGTR, New Delhi.
“You will be required to submit written submissions and the rejoinders (confidential and non-confidential versions) of the views expressed at the hearing within the date and time schedule to be indicated on the date of hearing. Kindly intimate the name(s) and email addresses of the person (s) who are expected to attend the hearing. The details of the Digital Video Conferencing will be shared with the registered interested parties shortly,” said Rajiv Kumar Soni, joint DGFT in a notice.
INEOS Phenols Singapore Pte Ltd had filed a name change application stating that the acquisition of shares of Mitsui Phenols Singapore Pte Ltd by INEOS Holdings Limited from its existing shareholders has resulted in a name change. The country involved in the review investigation is Singapore (also referred to as the "subject country"). In the final findings as well as the relevant Customs Notification of the original investigation, the anti-dumping duty has been imposed on the producer Mitsui Phenols Singapore Pte Ltd (56.91 USD per metric tons (MT).
The applicant had requested for amendment in the final findings which was issued vide Notification dated March 5, 2019 recommending definitive anti-dumping duty on the imports of "Acetone" originating in or exported from EU, Singapore, South Africa and USA (hereinafter also referred to as the "subject countries'').
In their application, the applicant has provided evidence and documents to establish the name change like the director's resolution of the Board of Mitsui Phenols Singapore Pte Ltd, authorizing the acquisition and providing further details thereof, the updated business profile of the company.
The company has also provided the constitution of INEOS Phenols Singapore Pte Ltd., including the certificate confirming incorporation of the company with the new name by the Accounting and Corporate Regulatory Authority of Singapore, updated certificate of registration of the plant as per the Workplace Safety and Health (Major Hazard Installations) Regulations 20I7 and press releases containing details of the acquisition and name change.
