DGTR to hold oral hearing in the anti-dumping investigation case of epichlorohydrin on Feb 8, 2024

The Directorate General of Trade Remedies (DGTR) will hold an oral hearing in the anti-dumping investigation case of epichlorohydrin (ECH) from Korea, Thailand and China on February 8, 2024 at 3:00 pm (IST) in the conference hall of DGTR.
ECH is used in pharmaceutical API and can be produced using propylene as well as using glycerine.
The DGTR had recently extended the timeline up to November 30, 2023 for filing responses in the anti-dumping investigation.
Meghmani Finechem Limited had filed an application before the DGTR for initiation of an anti-dumping investigation concerning imports of ECH from Korea, Thailand and China. The applicant has alleged that dumping of imports of the subject goods originating in or exported from the subject countries has materially retarded the establishment of the domestic industry and has caused material injury to the domestic industry.
“Interested parties who wish to join online may join through digital video conferencing. The web link and other details to join the digital video conferencing (DVC) will be shared with the interested parties over email,” informed Devender Singh, joint director, DGTR in a recent circular.
“Any registered interested party who wishes to participate, should provide the name of the organisation/company, e-mail, mobile number, landline number (with country/state code), name and e-mail of the participating legal representative/coordinator well in advance of the hearing date. A list of registered interested parties in the subject investigation is available on DGTR’s website,” DGTR further stated.
Singh further stated that it is required to make written submissions (confidential and non-confidential versions) of the views expressed at the hearing and file a rejoinder, if any, within the date and time indicated. Interested parties are advised to submit their written submission and rejoinder, if any, to the following email: dd15-dgtr@gov.in, with a copy to adv11-dgtr@gov.in. The non-confidential submission should be circulated through email by the registered interested parties to other registered interested parties.
The applicant Meghmani Finechem Limited has claimed that there are no known significant differences in the goods produced by the domestic industry and those exported from the subject countries. While the applicant has produced the subject goods using the bio-based glycerine route, the product can be produced using the propylene route as well. The applicant has submitted that there are no differences in the product manufactured using propylene, if any, and that produced using glycerine. ECH produced using both routes have the same technical and physical characteristics, applications, pricing and customers.
The subject goods produced by the domestic industry are comparable to the imported goods from the subject countries in terms of technical specifications, functions, uses, pricing, distribution, marketing and tariff classification of the goods. The applicant claimed that the two are technically and commercially substitutable. Therefore, for the purpose of the proposed investigation, the subject goods produced by the applicant are being treated as 'like articles' to the subject goods originating in or exported from the subject countries.
The DGTR notes that Meghmani Finechem Limited is the sole producer of like article in India. The applicant accounts for a major proportion of the total domestic production in India. In view of the above and after due examination, the DGTR notes that the applicant constitutes eligible domestic industry in terms of Rule 2(b) and the application satisfies the criteria of standing in terms of Rule 5(3) of the Rules.
